Terms of Service

These Terms of Service ("Terms") govern access to and use of Feedback-Us, available at feedback-us.com.

By creating an account, using the website, or using the Feedback-Us platform, you agree to these Terms.

1. The Service

Feedback-Us is a SaaS platform that helps businesses collect and analyze customer feedback through QR codes, web forms, dashboards, alerts, and AI-generated summaries.

The service may include:

• feedback forms;
• rating collection;
• QR code feedback flows;
• dashboards and analytics;
• AI feedback analysis;
• email notifications;
• weekly summaries;
• integrations with third-party services.

2. Who May Use Feedback-Us

You may use Feedback-Us only if you can legally enter into a binding agreement.

If you use Feedback-Us on behalf of a company or organization, you confirm that you have authority to bind that organization to these Terms.

3. Business Customer Responsibilities

Business customers are responsible for:

• using Feedback-Us lawfully;
• providing required privacy notices to end users;
• having a valid legal basis for collecting feedback;
• configuring feedback forms correctly;
• avoiding unnecessary collection of personal data;
• not collecting sensitive personal data unless legally permitted;
• handling end user requests;
• reviewing feedback before acting on it;
• complying with GDPR and other applicable laws.

4. Data Protection Roles

For feedback submitted by end users through business customer forms:

• the business customer is the Data Controller;
• Feedback-Us is the Data Processor;
• the end user is the Data Subject.

For account management, billing, website security, and service operations, Feedback-Us acts as an independent Data Controller.

Use of Feedback-Us is also governed by the Data Processing Addendum where applicable.

5. Accounts and Security

You must provide accurate account information and keep your login credentials secure.

You are responsible for all activity under your account.

You must notify us immediately if you suspect unauthorized access.

6. Payments and Subscriptions

Paid subscriptions are processed by Paddle.com Market Limited as Merchant of Record.

Pricing, taxes, invoices, renewals, refunds, and payment terms are handled by Paddle according to its applicable checkout terms.

Feedback-Us may change pricing or plans with reasonable notice.

If payment fails, access to paid features may be suspended or terminated.

7. Acceptable Use

You must comply with the Acceptable Use Policy.

You must not use Feedback-Us to:

• violate laws;
• manipulate public reviews;
• spam users;
• collect sensitive personal data without a lawful basis;
• upload unlawful or harmful content;
• harass, deceive, or discriminate against individuals;
• interfere with platform security;
• reverse engineer or abuse the service.

8. User-Generated Content

Feedback submitted through the platform is user-generated content.

Feedback-Us does not control, verify, endorse, or moderate all user-generated content.

Feedback-Us is not responsible for:

• accuracy of reviews;
• legality of feedback content;
• business responses to feedback;
• harm caused by customer-submitted or end-user-submitted content;
• publication or non-publication of feedback on external platforms.

Business customers are responsible for how they use, store, display, export, respond to, or act upon feedback.

9. AI Features

Feedback-Us may use AI to analyze feedback, classify sentiment, identify trends, generate summaries, and suggest actions.

AI outputs are provided for convenience only. You understand that AI outputs:

• may be inaccurate;
• may be incomplete;
• may misclassify feedback;
• may omit important context;
• are not legal, financial, medical, or professional advice;
• should be reviewed before use.

You are responsible for decisions made based on AI outputs.

10. External Review Platforms

Feedback-Us may suggest that positive feedback be shared on external platforms such as Google or other review sites.

Feedback-Us does not control third-party platforms. Feedback-Us does not guarantee:

• that a review will be submitted;
• that a review will be accepted;
• that a review will be published;
• that a review will remain visible;
• that ratings, rankings, or reputation will improve.

Business customers must comply with third-party platform rules.

11. Website Analytics and Tracking

Feedback-Us may use simple server-side logging to understand visitor numbers, referrers, UTM campaigns, and website performance.

Feedback-Us does not use Google Analytics, advertising pixels, retargeting cookies, or cross-site tracking unless disclosed and implemented in accordance with applicable law.

12. Intellectual Property

Feedback-Us and its software, design, branding, workflows, and documentation are owned by Feedback-Us or its licensors.

You receive a limited, non-exclusive, non-transferable right to use the service according to these Terms.

You retain ownership of your business data and feedback data, subject to the rights needed for Feedback-Us to provide the service.

13. Service Availability

We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free operation.

The service may be unavailable due to:

• maintenance;
• updates;
• infrastructure issues;
• third-party provider outages;
• security incidents;
• force majeure events.

14. Beta and Future Features

Some features may be experimental, beta, or planned for future release, including additional integrations.

Beta or future features may change, be delayed, or be discontinued.

15. Suspension and Termination

We may suspend or terminate access if:

• you violate these Terms;
• you fail to pay applicable fees;
• your use creates security, legal, or operational risk;
• required by law;
• your use harms Feedback-Us, users, or third parties.

You may stop using Feedback-Us at any time.

16. Disclaimers

Feedback-Us is provided "as is" and "as available".

To the maximum extent permitted by law, we disclaim warranties of:

• merchantability;
• fitness for a particular purpose;
• uninterrupted operation;
• error-free operation;
• guaranteed business results;
• guaranteed review publication;
• guaranteed AI accuracy.

17. Limitation of Liability

To the maximum extent permitted by law, Feedback-Us is not liable for:

• indirect or consequential damages;
• lost profits;
• lost revenue;
• reputational harm;
• loss of data caused by customer misuse;
• third-party platform decisions;
• user-generated content;
• inaccurate AI outputs.

Feedback-Us' total liability for any claim is limited to the amount paid by the customer to Feedback-Us for the service during the three months before the event giving rise to the claim.

18. Indemnity

Business customers agree to defend and indemnify Feedback-Us against claims arising from:

• unlawful use of the service;
• feedback forms configured by the customer;
• user-generated content;
• violation of privacy or data protection laws;
• misuse of reviews or AI outputs;
• violation of third-party platform rules.

19. Changes to the Service or Terms

We may update the service and these Terms from time to time.

If changes are material, we will provide reasonable notice.

Continued use after changes means acceptance of the updated Terms.

20. Assignment

Feedback-Us may assign these Terms and transfer the service, contracts, accounts, and related data to a successor operator. Where legally required, customers will be notified.

21. Governing Law

These Terms are governed by the laws of Ukraine, subject to mandatory consumer protection and data protection laws of the buyer's place of residence.
